These Terms of Service govern your use of the ProCloser.ai website and services operated by Thrive Ideas. By accessing our site or using our services, you agree to these terms. Our Privacy Policy is incorporated by reference.

These Terms constitute a legally binding agreement between you and Thrive Ideas (operating as ProCloser.ai). If you do not agree to these Terms, you must discontinue use of our site immediately.

ProCloser.ai, operated by Thrive Ideas, provides AI search optimization services including Generative Engine Optimization (GEO), Answer Engine Optimization (AEO), schema markup, content strategy, and related consulting services for professional services firms.

3. SMS Terms of Service

Program Description

The ProCloser.ai SMS program (operated by Thrive Ideas) sends appointment confirmations, meeting reminders, consultation follow-ups, service updates, and occasional promotional content related to our AI search optimization services.

How to Opt In

You opt in to receive SMS messages from ProCloser.ai by providing your mobile phone number and checking the SMS consent checkbox on our contact form at procloser.ai/contact/. By opting in, you confirm you are the owner or authorized user of the mobile number provided and consent to receive text messages from ProCloser.ai (Thrive Ideas) at that number.

Opt-Out Instructions

You can opt out at any time by:

• Replying STOP to any message you receive from us
• Emailing aaron@procloser.ai with subject line "SMS Opt-Out" and your phone number
• Calling 682.422.9276

After opting out, you will receive a one-time confirmation message and no further SMS messages will be sent unless you re-subscribe. Please allow up to 48 hours for processing.

Consent Not Required for Purchase

Consent to receive SMS messages is not a condition of purchasing any goods or services from ProCloser.ai or Thrive Ideas. You may decline SMS and still use our services via email or phone.

No Third-Party Sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Your phone number and opt-in data are used solely to deliver messages on our behalf via our SMS service provider. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Carrier Disclaimer

Carriers (including T-Mobile, AT&T, Verizon, and others) are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages.

Billing

We do not charge for our SMS program. Standard message and data rates from your wireless carrier apply. Contact your carrier for details on your messaging plan.

Prohibited Uses

You agree not to provide a phone number that is not yours, opt in on behalf of another person without their consent, or use our SMS program for any unlawful or abusive purpose.

4. Acceptable Use

By accessing our site, you agree to use it only for lawful purposes. You agree not to:

• Use the site in any way that violates applicable law or regulation
• Attempt to gain unauthorized access to any portion of the site or connected systems
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the site

Our site and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific results from our AI search optimization services, though we stand behind our work with our performance guarantee as described in individual service agreements.

7. Limitation of Liability

To the fullest extent permitted by law, ProCloser.ai, Thrive Ideas, and their respective officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the site or our services, including text messages that are delayed, undelivered, or misdirected for any reason.

In no event shall our total liability to you for all claims exceed the amount you paid to us, if any, during the twelve (12) months preceding the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless ProCloser.ai, Thrive Ideas, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the site.
